Please read these terms carefully before using our platform.

By accessing or using Oh/Jo Tech services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

  • These Terms constitute a legally binding agreement between you and Oh/Jo Tech, Inc.
  • You must be at least 13 years old to use our Services
  • If using on behalf of an organization, you represent that you have authority to bind that organization to these Terms

We may update these Terms from time to time. Continued use after changes constitutes acceptance of the updated Terms.

Oh/Jo Tech provides a facility management platform that enables efficient operations for recreational facilities. Our Services include:

  • Waitlist Management: Digital queue and waitlist systems for facilities
  • Resource Booking: Scheduling and reservation systems for courts, equipment, and spaces
  • Member Engagement: Communication tools, social features, and community building
  • Analytics & Reporting: Usage insights and operational metrics for facility operators
  • Mobile Applications: iOS and Android apps for end users and operators

Features may vary based on your subscription plan. We reserve the right to modify, suspend, or discontinue features with reasonable notice.

To access certain features, you must create an account. By creating an account, you agree to:

  1. 1Provide accurate, current, and complete registration information
  2. 2Maintain and promptly update your account information
  3. 3Keep your password confidential and secure
  4. 4Notify us immediately of any unauthorized access or security breach
  5. 5Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or for prolonged inactivity (12+ months).

Paid features are offered through subscription plans. By subscribing, you agree to the following billing terms:

Billing Cycle

Subscription fees are charged in advance on a monthly or annual basis:

  • Monthly subscriptions are billed on the same date each month
  • Annual subscriptions are billed on the anniversary of your signup date
  • Prices are subject to change with 30 days notice

Payment Methods

We accept major credit cards, debit cards, and other payment methods as displayed:

  • You authorize us to charge your payment method for all fees
  • If payment fails, we may retry and/or suspend your account
  • You are responsible for any fees charged by your financial institution

Refunds and Cancellation

You may cancel your subscription at any time:

  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial months (monthly) or unused time (annual)
  • Annual plans may be eligible for prorated refunds within 30 days of renewal
  • Contact billing@ohjotech.com for refund requests

You agree to use Oh/Jo Tech Services responsibly and lawfully. You must NOT:

  • Violate any applicable laws, regulations, or third-party rights
  • Use the Services for any illegal or unauthorized purpose
  • Transmit malware, viruses, or other harmful code
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the Services or servers
  • Scrape, crawl, or harvest data without permission
  • Impersonate another person or entity
  • Send spam, unsolicited messages, or harass other users
  • Post content that is defamatory, obscene, or promotes violence
  • Circumvent any access controls or usage limits

Violations may result in immediate suspension or termination of your account without notice or refund.

Oh/Jo Tech and its licensors own all rights to the Services, including:

  • Software, code, algorithms, and technical infrastructure
  • Trademarks, logos, and brand elements
  • Documentation, tutorials, and marketing materials
  • Aggregated, anonymized analytics and insights

You receive a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms. You may not copy, modify, distribute, or reverse engineer any part of our platform.

You retain ownership of content you create or upload to Oh/Jo Tech ("User Content"):

  • Your Data: You own your User Content including profile information, bookings, and communications
  • License Grant: You grant Oh/Jo Tech a worldwide, royalty-free license to use, store, and display your User Content as necessary to provide the Services
  • Data Portability: You can export your data at any time through account settings
  • Feedback: Any feedback or suggestions you provide may be used by Oh/Jo Tech without obligation

You represent that you have all necessary rights to the User Content you upload and that it does not violate any third-party rights.

If you use Oh/Jo Tech as a facility operator, the following additional terms apply:

  • Data Responsibility: You are responsible for obtaining proper consent from your members/customers for data collection
  • Compliance: You must comply with all applicable laws regarding customer communications (TCPA, CAN-SPAM, GDPR, etc.)
  • Content Moderation: You are responsible for moderating user-generated content on your facility's pages
  • Service Level: We provide commercially reasonable uptime but do not guarantee 100% availability
  • Support: Technical support is provided per your subscription plan terms

You agree to indemnify, defend, and hold harmless Oh/Jo Tech, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content
  • Any dispute between you and a facility operator or other user

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Oh/Jo Tech Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind
  • We do not guarantee uninterrupted, secure, or error-free operation
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim
  • Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you

Any disputes arising from these Terms or your use of the Services will be resolved as follows:

  1. 1Informal Resolution: Contact us first at legal@ohjotech.com. We'll try to resolve the issue within 30 days
  2. 2Arbitration: If informal resolution fails, disputes will be resolved by binding arbitration under the rules of the American Arbitration Association
  3. 3Class Action Waiver: You agree to resolve disputes individually, not as part of a class action
  4. 4Exceptions: Either party may seek injunctive relief in court for intellectual property violations

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any legal action must be brought in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

Either party may terminate this agreement:

  • By You: Delete your account at any time through account settings
  • By Us: We may suspend or terminate your account for Terms violations, extended inactivity, or at our discretion with reasonable notice
  • Effect of Termination: Your right to use the Services ends immediately; certain provisions survive (IP, Limitation of Liability, Indemnification)
  • Data After Termination: We will retain your data for 30 days after termination, then delete it unless legally required to retain

Additional terms that apply to this agreement:

  • Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement
  • Severability: If any provision is unenforceable, the remaining provisions remain in effect
  • No Waiver: Our failure to enforce any right does not waive that right
  • Assignment: You may not assign these Terms; we may assign them in connection with a merger or acquisition
  • Force Majeure: We are not liable for delays caused by events beyond our reasonable control
